A 1)1 Al FR I ES owner-driver who continued to run a truck on a surrendered English 0-licence has had his Scottish Area licence suspended for two weeks.

Paul Toner. trading as TS Transport, appeared before Scottish Deputy Traffic Commissioner Richard McFarlane.The DTC also had an application before him by TS Refrigerated Transport for a new international licence for two vehicles and two trailers. Toner was the sole director of that company.

Traffic examiner Joseph Logan said Toner held a licence for one vehicle in Scotland. In July he saw a vehicle in the livery of TS Refrigerated Transport in Dumfries.The North-Eastern 0-licence identity disc displayed in the windscreen appeared to be a valid disc expiring at the end of February 2006. However. the VOSA database showed that the licence had been surrendered in February 2005 and that the vehicle had been removed from the Scottish licence in January 2004 when another vehicle was specified.

Appearing for Toner., Michael Kilkerr said he had continued to use the second vehicle because of financial commitments. He now realised that was a bad decision.

He had surrendered the North-Eastern licence for financial and administrative reasons because most of his business was now from Lockerbie, near Dumfries. Toner had sold the offending vehicle within a month and currently only had one vehicle and trailer.Toner's Former transport manager. his brother-in-law, left in August but had been replaced.

Suspending the existing licence. the DTC said that Toner had retained his good repute and that he had no concerns over road safety.

The company's application would he granted at the end or the suspension period.
