Which of the following most accurately describes the problem?

• Prosecutions arising out of the carriage of football fans to the Leeds United football ground at Elland Rd, led to Wallace Arnold Tours Ltd being fined a total of £15 with £11 costs on three charges of operating without a road service licence by Pontefract borough magistrates this week.

The case first came before the magistrates on January 9 and Mr M. Patterson, prosecuting for the Yorkshire Traffic Commissioners, said the charges resulted from the defendant's operation to Elland Road on behalf of the Progressive Club, Knottingley. It was alleged that these operations were of a regular nature and that individual fares were collected, consequently they fell outside the ambit of a "private party".

The organizer at the club, Mr P. Lavender, said that each member making the trip was charged an individual fare.

For Wallace Arnold, Mr P. Fingret said advertising of the trips had been done without the company's knowledge. When advertisements had been brought to his attention he informed the club that such advertising was against the law. Wallace Arnold was not charging individual fares.

The magistrates found the cases proved and said the operation had consisted of the carriage of individual paying passengers over a regular route.
