Which of the following most accurately describes the problem?

A northern operator asks for a ruling in connection with the Motor Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 1964. He notes the definition of "overall length" given therein, but he is not quite clear if an extendible drawbar used in a temporary position for towing (but not supporting any load on the vehicle) is allowed above the 11 in. limit. In particular he wishes to establish whether he would legally be allowed to operate a vehicle which had an "overhang" of 60 per cent of the wheelbase, and/or an overall length of 11m. plus an extendible drawbar to the mar of the, vehicle for towing a trailer.

As in all such cases where there is no specific stipulation regarding the point raised, then the qualification must first be made that any such matters must be for the courts to determine. But relying on the decision of the court in the George Curtis appeal that they were bound by the Andrews v. Kershaw case, it would seem that the use of a retractable drawbar in the extended position would not result in the overall length or the overhang of a vehicle being in excess of that permitted by the Motor Vehicles (Construction and Use) Regulations.
