By Chris Tindall A PACKAGING haulier based in Peterborough says he will fight "tooth and nail" over any legal action brought against it after Fenland District Council claimed he is breaching restrictions over lorry movements.
Peter Once, director at PG Packaging, says he wants to see proof he has been breaching nightly HGV movements at his business premises.
The company, which has an 0-licence to run three vehicles and 10 trailers out of its Peterborough site, and also has an 0-licence to run HGVs out of an operating centre located in Arbroath, was given planning consent in 2003.
This was granted on the proviso that vehicles were restricted from entering or leaving the premises between lOpm and 7am.
A second condition was that forklift trucks used in the firm's packaging shed were also only operated between 7am and lOpm.
But a council spokesman says: -These conditions have been breached on a regular basis "Council officers recently carried out three separate nights of observations between 1 Opm and 4am over a two-week period, and they saw the breaches themselves "The owner was told again that the hours of operation must not be exceeded but the council has received further reports of 'out-of-hours' operations continuing."
He adds: "Failure to comply could result in prosecution."
But Once says the council has made a mess of the restrictions and claims his business was running 24 hours a day before he was granted permission.
He says: "I am going to tight it because it's a lot of nonsense."
