• A driver sacked by Wiganbased Rathbone Brothers after he refused to work on Good Friday has been awarded £2,302 compensation for unfair dismissal.

The tribunal heard that the day before Good Friday Alan Moorcroft had been told that if he did not work on the next day, he should not bother coming in on the Saturday as he would be finished. On the Friday afternoon, however, the company contacted Moorcroft and told him that he had not lost his job and that he should report for work on the Saturday. He was not prepared to do so.

Ruling the dismissal unfair, the tribunal said that Good Friday was a statutory holiday and Moorcroft was under no obligation to work on that day. The words used were clearly words of dismissal and a notice of dismissal could not be withdrawn unilaterally but only by agreement between both.
