TRANSPORT TRIBUNAL president Mr G. D. Squibb has rejected an appeal from a Peterborough operator following a prohibition issued on his ex-army vehicle because he failed to keep undertakings on the maintenance of the vehicle.
The Tribunal heard that Mr E. A. Graveling was operating the lorry for two weeks out of three on forestry work off the road. But Eastern LA Mr H. A. Robson had concluded that "the appellant was not really capable though he was willing and enthusiastic."
At the Transport Tribunal hearing, Mr Graveling told the court that he was now driving a lorry for a firm of potato merchants and it was proposed that he would buy the lorry from them and take over the licence.
Mr Squibb said it now seemed an entirely new case was being put forward. It was right that his licence should have been revoked by the LA on the evidence before him at the time.
He said the tribunal would not express an opinion on the new, circumstances — that was up to the Eastern LA to decide whether Mr Graveling now rated an 0 licence in his new job.
Mr Squibb rejected the appeal against the revocation of Mr Graveling's own 0 licence.
