THE Transport Tribunal last week dismissed the appeal by Silver Roadways, Ltd., London, E.16, against the refusal of the Metropolitan Deputy Licensing Authority to add 15 vehicles. each of 71 tons unladen, to their A licence. At the conclusion of the hearing last week, Mr. David Karmel, Q.C., for the company, said that they neede-d extra vehicles chiefly for carrying seigar for Tate and Lyle, Ltd.

A grant would enable sub-contracted work, which represented 81 per cent, of the company's traffic. to be reduced by 17 per cent.

Mr. C. R. Bedclington, for the respondents, the British Transport Commission, said that on the evidence there was no basis upon which the Authority could assess need for additional lorries. Earlier proceedings were reported in The Commercial Motor last week.

Giving the Tribunal's reserved decision, Mr. Hubert Hull, president, said that they knew of no case in which a, grant had been upheld by figures alone. The question was whether sub-contractors who worked for Tate and Lyle, Ltd., the parent company of Silver Roadways, Ltd., were unsatisfactory.

" In the result we don't think that the appellant company established that sub-contracted traffic was unsatisfactory to any such extent as would warrant us in reaching a conclusion that there ought to be substituted, at any rate for some portion of sub-contracted vehicles, vehicles owned and operated by the appellant company." said Mr Hull
