By Roanna Avison VOSA HAS insisted that it is within its rights to prevent an MoT being cancelled if it is not given notification at least three days in advance.

Dai Owen, the owner of Mold, Clwyd-based JD Owen Transport, contacted CM to say it had a test booked for a Wednesday, but the truck concerned developed a fault over the preceding weekend.

"I rang the Swansea test centre at the first available opportunity, which was the Monday morning, but was told I could not cancel the test because it was less than three days before the booking."

Owen then tried to swap a trailer test for the truck test, but was told this was not possible. "I am upset that I could not cancel a test when it had a fault that did not develop until the weekend prior to the test.

"If the test station had been open on the Sunday 1 could have cancelled three days beforehand."

Owen adds that the service-level agreement on Vosa's website stales that operators should cancel test appointments they no longer need, or where the vehicle will not be ready for test, at least three days in advance where possible.

"In this case I was not able to report the fact the test was not needed until two days before because the fault did not develop until the weekend."

However. a Vosa spokeswoman told CM: "According to Regulation 39, 3 of the Goods Vehicle (Plating and Testing) Regulations 1988. as amended, notification of a cancellation should be within seven days, bui under exceptional circumstances can he three days.

"It also clarifies what exceptional circumstances are and it specifically does not allow for breakdowns or non-availability of spare parts...
