tion and that it would prevent Servicemen from arriving home early on week-end leave, Shergold and White, Ltd. (Silver Star Coaches) appealed at Salisbury, last week, against the imposition of a condition of a backing granted by the Western Licensing Authority. The condition required them to wait at Perham Down camp, on Salisbury Plain. until Wilts and Dorset Motor Services, Ltd., had filled two coaches on their week-end leave services for Servicemen travelling to Birmingham. Mr. A. C. F. Wyndeatt, for Wilts'and Dorset, had submitted earlier that the appeal was not in order, but had been overruled. Mr. P. E. G. Mather, for

the appellants, said that had the argument been allowed, an application would have been made to the High Court. He asked that if the appeal was allowed it should be stated whether it was on a point of law or on the merits ol the case. Mr. Mather said the licence, granted by the South Eastern Licensing Authority, was for an express service from Tidworth to Birmingham. The Western Authority attached a condition that Wilts and Dorset should pick up two loads at Perham Down and his clients take the third. Thereafter, the two operators would take alternate

loads. This forced . the Silver Star to arrive in Birmingham an hour late.

Mr. Wyndeatt said it was not correct that Shergold and White had to wait at Perham Down until Wilts and Dorset had filled two coaches. Representatives of both companies took bookings at Tidworth on Thursday evenings, and 99 per cent. of the load was pre-booked. It took only a minute to fill a coach. Mr. Mather disagreed that such a high percentage was pre-booked.
