Which of the following most accurately describes the problem?

• A series of seminars explaining the transfer of undertaking laws—legislation protecting employees when contracts change hands—is being run by the Freight Transport Association.

The ETA's move follows a number of recent cases where hauliers taking over new contracts have been forced to take on existing workforces or pay thousands of pounds in redundancy payments. Transfer of undertaking regulations protect the employee when a company is taken over or a new contract is won. An increasing number of hauliers are finding that when winning contracts the responsibility for previous employees and drivers falls on their shoulders.

John Sparham, the ETA's head of training, says: "This is an increasingly important issue especially in local authority contracting."

Aberdeen-based Bonaccord Transport had to pay thousands of pounds in redundancies when it took over a contract. A company director says: "We won the contract fairly and squarely only to be told we had to take on the previous contractors' staff. We tried taking legal action but we were told we would lose—and it had cost us enough already." For information on the seminars contact 01892 552302.
