Which of the following most accurately describes the problem?

• A bid for a PSV Operator's Licence by Malcolm Vehicle and Coach Hire has been refused on the grounds that it is a new guise for a coach company run by former Taphaul boss Thomas Malcolm.

In July Taphaurs goods vehicle 0-licence for 40 vehicles and 60 trailers was revoked by Scottish Traffic Commissioner Michael Betts.

Thomas Malcolm was disqualified from holding a licence for 10 years after 17 drivers were found to have committed 113 offences of falsifying tachograph records.

Janice Malcolm was also disqualified.

The TC revoked Malcolm's PSV 0-licence, held in the name of Taphaul Minicoaches, and disqualified him from holding such a licence for three years (CM 6-12 July).

Refusing Malcolm Vehicle & Coach Hire's licence application, the TC said that the Malcolms together would have a very significant controlling interest in the company.
