Which of the following most accurately describes the problem?

• Having reserved his decision on an application by W. Armstrong (Westerhope) Ltd., Birley, after a re-hearing in Newcastle last year (CM October 11 1968), the deputy Northern LA, Mr. J. A. Baldwin, listed the case for further consideration in Middlesbrough last week.

The company had originally applied for a new A licence for six vehicles to the LA, Mr. J. A. T. Hanlon, on April 19 1968, which he refused. But following an appeal (CM July 26 1968), the Transport Tribunal ordered a rehearing to give the applicant an opportunity to answer a report from the Metropolitan traffic area which the LA had taken into account when reaching his decision.

Prior to this, in June 1967, the LA had deleted the vehicles from Armstrong's licence under Section 177 and, following his refusal in January 1968 to grant a second short-term to enable the company to carry on the business, the substantive application had been lodged.

In Middlesbrough Mr. Baldwin said further figures and a doctor's certificate regarding the health of Mr. J. W. Edwards, Armstrong's managing director, had been submitted. He had also received a letter from Mrs. C. M. Graydon, the owner of the depot where it was hoped to continue running the business, in which she wrote that she was prepared to lease the property to Armstrong.

Having regard to this further information. the deputy LA said he would grant a new A licence for two vehicles, a fourand a sixwheeler, both to be acquired.
