1CASE HIGHLIGHT The continued use of vehicles knowingly without the authority of an 0-licence is almost bound to jeopardise the good repute of the operator.

A Merseyside haulier who continued to run his vehicle after his licence had been revoked has had his application for a new Operator's Licence refused.

William Mobey, trading as WFM Transport of Crosby, was seeking a new licence and the return of his impounded vehicle before the North Western Deputy Traffic Commissioner Tom Macartney.

For Mobey, John Earnshaw said that he wanted his vehicle returned on the grounds that he had previously held an 0Icence, though he did not hold one at the time the vehicle was impounded.

Refusing to return the vehicle, the TC said that it was a futile application as Mobey was aware that his previous licence had been revoked.

Traffic examiner Sue Muller said that on 8 January a 38tonne artic laden with a container and driven by Mobey was stopped in a roadside check.

The container was being taken from Ellesmere Port to Nottingham. No 0-Licence disc was displayed.

Enquiries revealed that Mobey's licence had been revoked at a Public Inquiry because of the unauthorised use of an operating centre and an unsatisfactory maintenance record.

Mobey said that a gross overload, which led to a conviction in January, had occurred just prior to the end of his previous licence, He agreed that he had used the vehicle on a number of occasions because he had been short of money.

He used the vehicle in January, as he said he needed to run it while loaded to check for any oil leaks before 'it went in for test. He agreed that Ellesmere Port to Nottingham was a long way for a road test but said that he had only found out that morning that a request for an interim licence had not been granted.

Mobey's nominated CPC holder Graham Alison, proprietor of GA Transmanagement, said that he had been unaware of the unauthorised use of a vehicle by Mobey. He had reminded him that he should not use a vehicle without an 0licence: but was still prepared to advise Mobey if a licence was granted.

Refusing to grant a licence, the DTC warned that further unauthorised use could well debar Mobey from the industry altogether.
