On 11 August 1988, a broken-down Mercedes artic, driven by Byerley, was discovered in the Watford Gap Service Area. No 0-licence identity disc was displayed. Tachograph charts produced were of the wrong type for the truck's tachograph. Two charts had double traces, having been left in the tachograph for over 24 hours. On 26 November 1988, a Daf artic was found broken down in the nearside lane of the motorway. No 0-licence disc was displayed.

Police went to the registered office of the company at 14 Station Road, where they interviewed company secretary Susan Caroline O'Neill. When asked whether the company had an operator's licence, she said it had been applied for_ Statements were also read concerning a vehicle driven by Graham which was stopped on 31 July 1988. It was said that the vehicle was owned by J & E O'Neill. No excise licence or 0-licence identity disc was displayed and serious defects were found.

Sentence on Graham and Byerley was adjourned until 15 August.
