by Kathy Watson • Solicitors acting for owner-driver Kay Phillips have issued a writ against Scantruck of Purfleet, Essex alleging negligence over a temporary repair to her truck.

Phillips, of Market Drayton, Shropshire, is claiming just over .£12,000 for repairs, lost earnings and bank interest payments.

The writ follows an inci dent in December 1991 when she discovered an oil leak after delivering a load. According to Phillips' claim, Scantruck discovered a horizontal main bearing bolt had sheared, causing the leak from the engine block. Scantruck said there was not time to do a repair to the bolt but it would be able to carry out a temporary repair to get Phillips home, some 200 miles away. Phillips claims Scantruck applied sealer around the sheared bolt and wedged the bolt in the hole. She says that when she returned she had the vehicle checked and a large crack was found in the cylinder housing as well as other damage which she claims was a direct result of the temporary repair.

A Scantruck spokesman says there have been negotiations with Phillips and, following the writ, it is in the hands of the company's legal advisors.
