A SCAFFOLDER WHO vowed to -play by the rulesin the future has failed in a bid to have his impounded vehicle returned. A public inquiry heard that he used a newspaper cutting to create the impression of displaying an 0-licence disc and that he had previously been convicted of operating without an 0-licence.

Colin Holliday, from the Isle of Sheppey in Kent, had his vehicle confiscated in November while it was carrying scaffolding equipment. In his application for its return he said: "I'm just a working man trying to earn an honest living, only I didn't play by the rules —which I intend to do from now on."

Holliday told the inquiry he was in the process of applying for an 0-licence.

Refusing to return the vehicle. South-Eastern & Metropolitan Traffic Commissioner Christopher Heaps said Holliday had previously held an 0-licence, when trading under the name of CD Scaffolding Services, and he had been convicted in June 2004 of using a vehicle without an 0-licence.

Holliday admitted that he had removed from the windscreen and discarded part of a newspaper cutting which was similar in size and shape to an 0-licence identity disc:Ibis had been displayed when the traffic examiner first saw the vehicle.

Holding that Holliday had failed to demonstrate any Summary grounds for the vehicle's return, the TC considered that he was aware of the requirements of the Goods Vehicles (Licensing of Operators) Act as he had previously held an 0-licence, had previously been convicted of unauthorised use and had admitted that he "was 100% in the wrong".
