Which of the following most accurately describes the problem?

• A truck driver will appear in court next month following a coroner's open verdict on the death of a motorist.

Brian Daniels of Elm Park, Essex is due to appear at East Powder Magistrates Court at Bodmin, on 9 September.

Anette Olsen-Hammond died following an accident in St Austell, Cornwall on 4 March.

East Cornwall Coroner's Court heard how Mrs OlsenHammond died almost instantly when her car was struck from behind by Daniels' Volvo truck.

According to evidence given at the inquest there was a total failure of the tractive unit's brakes due to a fractured air hose..

During the inquest coroner Dr David Bruce said the vehicle's brakes were severely defective and showed evidence of long-term neglect.

But he said there was not enough evidence for him to find that there had been recklessness or a wilful disregard of safety.

Daniels is charged with driving a vehicle with defective brakes; operating without an 0-licence: and four tachograph offences.
