Which of the following most accurately describes the problem?

THE FUTURE of a Lancashire haulage company hangs by a thread after North Western Traffic Commissioner Beverley Bell described its repute as lying "in tatters upon the floorand accused its two managers of offering unreliable evidence.

Farriworth, Bolton-based, AL Madina Transport must now wait to learn what action will be taken against its 0-licence after the disciplinary inquiry in Wigan. A similar hearing last November was adjourned to enable a traffic examiner to complete an investigation. The company was subsequently fined £500 for failing to produce tachograph records, with £150 costs.

Madina's transport manager William Gardiner said that Nazir Hussain, Madina's director, was running the business from his home because of an injured back and rarely came to the operating centre. Gardiner added that he worked 16 hours a week for Madina, being employed as a driver by another operator during the week. He had been asked to sort out the tachographs as Hussain had had a little bit of trouble with the drivers". Maintenance was left to Hussain. Gardiner claimed he was being paid £500 a month by the company.

Hussain agreed that he ran the business from home but claimed he paid Gardiner £215 a week for three days' work. The business had been purchased from Liaquat Ali Majeed, whose own licence had been revoked and who had been disqualified from holding an 0-licence. Majeed, a former director, still helped out on occasion.

Pointing out that documents had been sent to the Traffic Area Office using Majeed's fax machine, the TC said she did not consider that the evidence of Hussain and Gardiner could be relied upon. She warned that she was considering revoking the licence and disqualifying the two directors indefinitely.

The TC is to announce her decision in writing at a future date.
