Wiltshire-based John Patrick Black has lost his 0-licence with effect from the end of March because of maintenance problems and irregularities over vehicle excise duty.

Black was unable to attend the original inquiry before Western Traffic Commissioner Philip Brown because of a workshop injury. It was alleged that several vehicles had changed registration numbers, and many had not been registered for months.

The IC was also given details of 13 prohibition notices imposed on Black's vehicles (CM11-17 Jan).

When the hearing resumed, Paul Carless, appearing for Black, alleged that vehicle examiner Maxwell Carr had been abusive towards Black's staff. Black now planned to contract out his maintenance to a company considered acceptable by the Vehicle Inspectorate.

"He and I will meet with the DVLA within four weeks to resolve every matter on the list," Carless added, referring to the VED irregularities. "This resolution will be to the satisfaction of the operator and the DVLA."

Black accepted that vehicles should have been taxed at the correct rate and that offences had taken place. "Some of the prohibitions Mr Carr put on were ludicrous," he claimed, but admitted: "Mr Carr is a very thorough man."

"I think Mr Garr should give us a fair chance," he concluded, 'That's all I'm asking for—Mr Carr is treating me like a second-class citizen."

Revoking the licence, the TC said he was making no finding against Black's repute and that would give him a chance to start with a clean sheet and with a fresh licence.

"Providing you can satisfy me that maintenance systems and tax are in good order, there may not be a need for another public inquiry," Brown concluded.
