Which of the following most accurately describes the problem?

• The Minister of Transport has turned down an appeal made by Hebble Motor Services Ltd. against the decision of the Yorkshire Traffic Commissioners, granting to J. H. Sheard Ltd. a variation of the conditions attached to a road service licence for excursions and tours starting from Harrison Road, Halifax.

The appeal was brought on the issue of vehicle allowance, which the Commissioners had increased from seven to 10 vehicles for the Spring Bank Holiday, the local fortnight holiday in July, and the September break (as compared with the increase to 14 vehicles at these times and at Easter also which the respondents had applied for).

The Minister noted that while the appellants on occasion had spare capacity on their licence, the Commissioners had concluded that the increase that they granted to the respondents was justified in order to accommodate the customers who preferred to travel with the respondents.

The existing vehicle allowances of the two operators taken together could not be regarded as excessive for the excursion requirements of Halifax, and the Minister thought that an increase in the vehicle allowance of the respondents would afford the public a greater choice and would not be likely to harm the appellants.

The Minister endorsed the suggestion made by the Commissioners in the course of their oral decision that the operators by co-operation with each other might offer a wider choice of destination to the public.
