A DRIVER who did not know that he had to keep tachograph records of his driving activities in a 20,000-acre forest has been fined £300 by Harlow Magistrates.

Philip Reid Rotherham pleaded guilty to six offences of exceeding 10 hours daily driving, driving for four and a half hours, driving without taking the required breaks, taking insufficient daily rest and knowingly making a false record. Prosecuting for Vosa, Jacqueline Devonish said Reid breached the drivers' hours rules by failing to pay heed to the requirements, with the offences taking place over two months.

For Reid, it was said that the offences had been committed out of ignorance. He had been a recovery vehicle driver for five years and had not needed to use a tachograph. In particular, he had not recognised the need to record all mileage when driving in a 20,000-acre forest area where there was no danger to the public or other road users. Reid had not been hiding his hours by not recording his mileage. He had lost his job as a result of the offences and had been unable to claim any income support or find another job as a driver.

In fining Reid, the magistrates said they would normally regard such offences as serious.
