Which of the following most accurately describes the problem?

• The grant of an additional B-licensed vehicle to K. Millichamp of Atherstone was deferred until February 1 by the West Midland LA, Mr. J. Else. in Birmingham last week. "I have no doubt that the evidence justifies the additional vehicle but I have to take into account two things," he said.

One was that Millichamp had been convicted at Atherstone for failing to keep proper drivers' records and for operating in breach of his licence conditions. The other factor was that he had been operating a new vehicle since October 31 without authority.

Mr. Millichamp explained that he had sought advice from the RHA and had called at the LA's office for a short-term licence. He had been issued with a receipt which he understood was his authorization. On a previous occasion he had assured the LA that he wished to operate lawfully and this was still his intention, he said. He sought to carry export traffic to the docks and was not interested in rubbish disposal.

Evidence of a 90 per cent growth in export traffic due to the division taking over European distribution, was given by Mr. D. W. Poole, traffic superintendent, Minnesota Mining and Manufacturing Co. Ltd., to whom the licence will be restricted. During the period September/October/November 1968, out of a £3,729 total earned by the five Blicensed vehicles, this company had paid Millichamp £3,068, in addition to £661 for a contract vehicle, said the LA. It was clearly employing all the vehicles and the grant would be made providing the applicant undertook not to operate before he got the disc on February 1.
