MANY AMENDMENTS TO P.S.V. REGULATIONS
New Detail Alterations to Licensing Provisions
I N view of the passing of the Road Traffic Act, 1934, the Minister of Transport proposes to amend the Public Service Vehicles (Licences and Certificates) Regulations, 1933, and the Public Service Vehicles (Drivers and Conductors Licences) (No, 2) Provisional Regulations, 1931, as amended on June 27, 1933. A small amendment is also to be made to the Public Service Vehicles (Lost Property) Regulations, 1933. The principal new proposals are as follow :— In the first-named regulations, Clause 10 is to be amended so as to give power to an examiner appointed under the Road and Rail Ttaffic Act, 1933, to inspect a licence or backing. Clause 14 is to be altered so that subparagraph (iv) of paragraph (3) will provide that a copy of an appeal shall be sent to the applicant "in the case of an appeal by a person who opposed the grant of, or the variation of any condition attached to, a road service licence or backing . . ." In Regulation 18 the proviso is to be inserted to the effect that a refund will be payable to a licence-holder, whose vehicle has passed permanently out of his possession, at the rate of 10s. for every two complete calendar months unexpired at the date of the surrender of the licence and the plate.
In connection with the drivers and conductors licence regulations, a driver may be required to satisfy the Commissioners that he is acquainted with the provisions of the Highway Code, instead of giving evidence to show that he holds a driver's licence.
Clause 7 of these regulations will be replaced by one stating that a licence for a period of less than two years shall cost is.; over two years but less than three years, 2s. ; and three years, 3s.
By the amendment of Regulation 9, which will become No. 10, licensees will be relieved of the need for sending their licences to the Commissioners for endorsement, in the case of a change of address. Clause 10 will be omitted. Regulation 11 will be altered to give power to an examiner appointed under the Road and Rail Traffic Act, 1933, to demand to inspect a licence.
In connection with Regulation 17. the licensee whose badge has been lost or destroyed shall forfeit the deposit previously paid and shall pay a fresh deposit of .2s. 6d. for a new one. If the badge becomes defaced, the Commissioners shall issue another one after the damaged badge has been surrendered.
These proposals have been placed before the national associations of operators and of local authorities for their consideration. The Minister states that it will be necessary also to make regulations as to the records to be kept by contract-carriage operators. It is hoped that drafts of these regulations will be circulated at an early date.
