DEVON County Council has issued a high court writ against fa hauliers and two county court summonses against two for allege( causing excessive road damage.

Under section 59 of the Highways Act 1980, an operator is liable for the damage caused a road if "extraordinary" use the road is being made. County Council legal spokesm admitted that the interpretati of the word "extraordinary" the bone of contention.

It is thought that the amok of money being sought by t council is relatively small, pi sibly no more than £2,000 IR any single operator.
