OPERATORS disagree with the imposition of prohibitions, ay can always appeal against them at the time, said West Aland Licensing Authority, Arthur Crabtree, at Birmingham I week.

The comment came after Trence Rawlins, the transrt director of Rawlins Bros irmingham) Ltd, had said at he did not feel that defects and on two of his company's hides warranted immediate ohibitions.

The company, which held a ence for 79 vehicles and one tiler in possession, with 10 hides to be acquired, was pearing at disciplinary proedings for the second time thin six months.

Mr Crabtree said that since e last inquiry, in August, 78, when the company esped with a warning because its past good record, there td been two further imediate prohibitions placed its vehicles. Technical officers from the hgv testing station at Garratts Green, gave evidence that two Mercedes vehicles presented for test had been prohibited for defects which indicated neglect.

Mr Rawlins said the type of work undertaken was heavy, 50 per cent of the vehicles' time was spent on site or on tips, and they took a hammering. Since October, 12 vehicles had been presented for test without problem.

For the company, Michael Carless said the problems in the past had arisen due to inadequate premises. However, the first class new premises, which the LA had been told about last August, were now fully operational. He argued that when an operator was operating the number of vehicles that Rawlins had, there was bound to be an occasional prohibition imposed.

Removing the margin for increase from the licence, Mr Crabtree said over E100,000 had been spent in improving maintenance facilities, so it could not be said that the company was deliberately failing to comply with its undertakings.

However, it was a matter of concern that two vehicles which were presented for annual test, and must therefore have been prepared, came to receive immediate prohibitions marked "neglect."

He could not let an unsatisfactory state of affairs pass for a second time without making his displeasure felt.

The licence expired in January, 1980, and he would require a very full fleet inspection to be carried out before renewal was granted.
