tion Tribunal confirmed an agreement between the Road Haulage Executive and Gilchrist Road Service, Ltd., Croydon, for the payment of £28,000 compensation to the company. A sum of £27,000 had been originally agreed upon.

Mr. Patrick Browne, for the R.H.E., said that having regard to the Tribunal's decision in the case of Arthur 3. 1Viaggs and Co., Ltd., in which it had been held that excess profits tax and profits tax should be added back in calculating the average net annual profit, the parties a2g had agreed to the substitution of £28,000 for the earlier figure_ Mr. Browne added, however, that the agreement to which the R.H.E. was prepared to arrive must not be taken as prejudicing the claim which the Executive might make in the Court of Appeal in the Maggs case or in any subsequent proceedings before the Tribunal.

Mr. C. Montgomery White, K.C., president, directed that the costs of the applicant should be borne by the R.H.E.

Gilchrist Road Service, Lid„ which was an old-established business, ran 24 lorries and one trailer.
