advice. The ADC has been advised that action can be taken against the Transport Department — but the Confederation was advised that no action could be taken except in one specific case. This is believed to be the occasion when West Yorkshire PTE were asked by the Department to repay grant cash already handed over.

Legal opinion taken by the ADC was that the DoT had no power to revoke approval previously given and suggested that the DoT was obliged to pay out. The Confederation told me that when the rationing agreement was first drawn up they knew that cash already promised by "approval in principle" would come out of the allocation for the year when the vehicles were delivered and the grant actually paid.
