THE REVOCATION OF the licence held by Aldershot-based Paul Aylward, trading as Aylward Contractors, in the Western Traffic Area, and its disqualification from holding or obtaining an 0-licence in any traffic area for three months has been upheld by the Transport Tribunal on appeal.

Western Area Deputy Traffic Commissioner Philip Brown was told that the vehicles were not kept at Aldershot, but were located in premises in Surrey.

Aylward said that in 2004 he was sent a notice to quit his Aldershot premises, so he found a site near Woking in April 2008 and made an bid for a licence in the South Eastern and Metropolitan Traffic Area in December 2008. He accepted he had been working from an unauthorised operating centre since 2004. And he agreed he had been operating as a limited company, Aylward (Contractors) Ltd, since 2007 In addition to making the revocation and disqualification orders, the DTC refused to grant an interim licence in the South Eastern & Metropolitan Area (Suspension for using unauthorised centre', CM 19 March). For Aylward, Patrick Sadd argued the order for disqualification was disproportionate.

He said Aylward had resigned as a director of the limited company and was no longer involved in the management of the business. Also, a new transport manager had been appointed.

The Tribunal said that the length of the disqualification had been a merciful outcome when Aylward had been knowingly in breach of 0-licensing requirements.
