FIVE FIRMS, all sabsidiaries of clesfield, have won permission depot on Sundays.

The firms appealed to magistrates to overturn a local council notice which required them not to work on Sundays at the depot, to carry out loading and unloading within the warehouse complex land to ensure that vehicles travelling on site between 10pm and 8am restricted their speed to a maximum 5 mph.

The magistrates deleted the requirement not to work on Sun days and decided to allow firms to carry out loading and unloading on any day within the warehouse building at any time but elsewhere on the site only between 6am and 11pm. They upheld the 5 mph speed limit.

Roger Brown, for Speedwell, had said that unless the court quashed the order the firms were going to be very severely restricted and their future would be threatened.

John Rowland, for the council, said there was a nuisance arising from the work at the premises and he alleged that unloading during the night was not always carried out inside the warehouse.

"The council's intention in serving the notice has been to achieve a reasonable and fair balance," he said.
