111 The Transport Tribunal in a written judgment says that the South Eastern LA was entirely justified in imposing the condition appealed against by Khami Metals Co Ltd, scrap metal merchant, with a yard at Blakes Lane, Tedley, Hampshire, as operating base.

There was no evidence, says the Tribunal, that the imposition of the condition on ingress and egress except in exceptional circumstances from a westerly direction would prejudice the business.

Probably for these reasons, it says, at the appeal Mr Pears, instructed by Letcher & Son, did not seek to raise these matters which were in the notice of appeal. He submitted, however, that there had been no evidence of environmental damage and the condition would increase the use of Blakes Lane between the centre and the A340 to the detriment of residents.

Dismissing the appeal, the Tribunal says there was abundant evidence of environmental damage if the application to vary the licence to four vehicles and two trailers from two vehicles, was granted, so decided to limit that damage to the section to the west of Blakes Lane which is more suitable to large vehicles than the approach via Broad Halfpenny Lane.
