Which of the following most accurately describes the problem?

• Robert Montague, the chief executive of troubled trailer rental group Tiphook who earns £1.3m a year, has been served with a personal bankruptcy petition. If his main creditor, The Royal Bank of Scotland, is successful in proceedings at Oxford Crown Court on 28 October, Montague would have to resign. Under company law, a bankrupt cannot sit on a company board.

But a spokesman for the company says bankruptcy is not a forgone conclusion as Montague remains in talks with his creditors. Some reports have suggested that if Montague was forced to resign, Tiphook would retain his services on a consultancy basis.
