Which of the following most accurately describes the problem?

• The licence held by Dumfries coal merchant William Borthwick has been revoked by Scottish LA Michael Betts on maintenance grounds. The LA has also rejected Borthwick's application for a fresh licence. Borthwick, who held a licence for one vehicle based at Old Station Yard, Thornhill, had been called to a Dumfries disciplinary inquiry following the issue of a prohibition notice to his vehicle.

Betts said that Borthwick had failed to adhere to a statement of intention given when he applied for the licence that he would make proper arrangements to keep his vehicles and trailers in a fit and serviceable condition. The LA was not satisfied that there would be satisfactory facilities and arrangements for maintaining the authorised vehicle in a fit and serviceable condition.
