There was no disagreement between the two operators over the need to improve facilities along . Darnley Road and Parkhouse Road: the issue was whether this should be done by re-arranging Western S.IM.T. services or extending The Commissioners concluded that McGill's had failed to establish a case for the extension of their facilities, and refused the company's applications without calling upon Western S.M.T. to give evidence in support of their objections.

Mr. Reith considered that, although much of McGill's evidence was open to criticism, the appellants had established a prima facie case. He advised that the case be reheard by the Commissioners.

In the Minister's view, however, McGill's evidence reflected no more than "a. desire for a general improvement," and fell short of demonstrating need. The 'Commissioners were justified in thinking that Western S.M.T. would lose traffie if McGill's proposals were.put into effect.

McGill's are to pay the costs of the appeal.
