Anthony Ostrin, prosecuting for Vehicle and Operator Services Agency (VOSA),said a vehicle operated by Superfresh was the subject of a check by the Vehicle Inspectorate enforcement division. An examination of the vehicle showed it was displaying an expired 0-licence disc and it was laden with wooden pallets Not returning a tachc record sheet No tacho two-yearly Prosecution costs £350 at the time. A further expired licence disc was on the dashboard. The driver was asked to produce charts and in doing so it was seen that a chart had not been handed in to the operator within the 21-day period. An inspection of the tachograph equipment showed that there had not been an inspection since 1999 Enquiries at the traffic area office showed that Superfresh had previously held an operator's licence but it had been terminated in November 2002.

When interviewed, a company representative said the incident had been an oversight and the vehicle had not been used since mid-December as it had been away for repair.
