On March 26, July 24, and November 27, 1959, applications had been made to vary Haigh's contract-A licence. False statements had been made when it was said that vehicles which were specified on Haigh's licences were to be substituted. In fact, they were not in Haigh's possession.
Lum owned two vehicles and had operated them on 12 occasions in 1959 without licences with the help of Haigh's. This was revealed when he had tried to obtain a contract-A licence.
Haigh's had sold the original vehicle on contract-A licence to Lum. He had replaced this vehicle with other vehicles, but Haigh's applied for the variation of the licence. Evidence was given that a customer paid accounts to Haigh's, but Lum was given 90 per cent. of the amount received.
