The hearing concerning J.R.M. (Plant) Ltd., of Harlow, Essex, had been adjourned at its first hearing in July because Mr. J. R. Menhinick, director, asked permission to question the MoT examiner who issued five immediate and five delayed prohibitions at a fleet inspection early this year.

Mr. Menhinick, seated at the advocates bench, proceeded to cross-examine Mr. A. Scott-Farneli, the Ministry examiner, in the witness box.

Mr. Menhinick said a trailer had been the subject of an immediate GV9 because the service brakes were faulty. "What was inefficient on that trailer?" he asked.

The examiner replied that the brakes were not able to stop the vehicle within a reasonable distance.

Mr. Menhinick claimed the examiner had insisted on the trailer brakes being able to lock the wheels when tested in the yard and said: "I made representations to you at the time that there was nothing more dangerous than having a trailer whose brakes would lock at a touch of the brake. Your advice to roe when you left was to let the brakes off a bit so they wouldn't lock and to get the driver to be careful."
