He said he desired to raise the question as to whether the proposed licence condition limiting the speed of vehicles to 30 m.p.h. or to a lower speed was not
utra vires. The speeds of certain classes of vehicle had been specifically dealt with in the Road Traffic Act, 1930. He contended that the power of the
Commissioners in this respect was restricted by the Act to the scrutinizing of time-tables to see that the speed limits already fixed should not be exceeded. A condition endorsedupon the licence was tantamount to an alteration of the speed limits, which, Parliament had said, could be altered only in a certain manner. The Commiasieners stated that they ,proposed, to impose_te _Condition with a modified wording and they welcomed the testing of the legality of their decision.
