The 140 Transport & General Workers Union members are also angry that TDG is not prepared to take all of them on under the TUPE regulations, which protect terms and conditions when con tracts change hands.

Ron Webb,T&G national secretary for road transport, says the company cannot pick and choose where to apply the regulations: "TDCi should recognise the situation is nonsense and put it right."

The union is due to decide the date of the action this week — it could take place while the drivers are still employed by Wincanton, the existing contractor. This is because neither Wincanton nor TDG have told the union when the contract will change hands.

TDG says the TU PE rcgs will apply in the South-West but not in the South-East. because there is no identifiable "stable economic entity" to the contract in this part of the country. But it acknowledges further information might come to light that could make it reconsider its position.

• A strike ballot is expected among 1,000 T&G members who work in distribution for the Co-op following its decision to scrap final-salary pensions (CM 12 January ).

Webb says shop stewards have requested the vote, which will now go before the union's executive for approval: "Our transport members have made it clear they will do all they can to keep the pensions."
