As the vehicle is less than 3.5 tonnes, and providing you do not tow a trailer which would take it over 3.5 tonnes carrying capacity, you are exempt from the EC drivers' hours rules.

You are very likely, particularly if you drive for more than four hours a day. to have to comply with the domestic hours rules set out in the Transport Act 1968, section 96, and the various modification regulations. In basic terms there is a daily driving limit of 10 hours and a duty limit of 11 hours. There is a full guide, to these rules on the VOSA web site (www.vosa.gov.uk).

Unless you are genuinely self-employed, however, you are subject to the working time regulations after 1 August 2003, as a mobile worker outside the EC drivers hours rules.

Your basic rights are: • Four weeks' paid holiday per year (including bank holidays) • Health assessments if you are a night worker • An average 48-hour working week unless you have signed an opt-out • "Adequate" rest each day and week The rules are complex and the employer does have some flexibility so you will need specific advice on your situation.
