• Jenny Hawes has won her long-running fight to keep her Cambridgeshire roadside cafe following a decision by the Department of Transport to drop an eviction order banning her from the site.

Hawes' victory means she can continue to trade at the SitIn Cafe at the Chapel Lane layby on the A47 near Wisbech but she is still to decide whether to drop an official complaint against the DOT.

The DOT's change of mind follows comments made by the county court judge who in May granted the eviction order against Hawes. He had said although Hawes and her husband Peter had no licence to operate from the site, the DOT had given them some encouragement to trade there.

The DOT says: "It has been decided that it would not be equitable—in view of the judge's comments—for the Highways Agency to prs for the execution of the posossion order." However, it says it will keep its position under review.

Hawes had refused to move, saying that a complaint to the Parliamentary Ombudsman against the DOT is outstanding. She has accused the department of maladministration.
