CUMBRIA County Council's controversial plans for fines of up to £200 against operators which are suspected of being likely to cause damage to a pavement have been thrown out by a House of Lords select committee (CMJune 27).

Cumbria wanted a clause to this effect to be included in its private Bill going through Parliament, but there were serious doubts about whether it could have been enforced.

Home Secretary William Whitelaw referred the clause to the Lords committee, recommending that it be dropped, and this advice has been followed.

The Freight Transport Association, which objected to the scheme in co-operation with the Brewers' Society and the Confederation of British Industry, this week welcomed the move as it would have created a precedent which other councils may have followed.
