A SIX-MONTH suspension was imposed on the licence for one vehicle operated by John Wishart Ltd., by the Scottish LA, Mr. A. B. Birnie, in Edinburgh on Tuesday. The firm had received two immediate GV9s and one delayed GV9 earlier this year.

At the same hearing an application to widen the scope of a B licence, and one adding a vehicle to the fleet were refused; but Mr. Birnie granted the replacement of a van by a fiat truck.

The supporting evidence, said the LA, was not as great as he normally expected. Moreover, the applicant had been told that the LA was going to take his previous conduct as a haulier into account and Mr. Birnie would therefore have expected much stronger evidence.

Mr. Birnie said the vital thing was that the firm had appeared before him two or three years ago "and got a chance", on the understanding that it was going to be "looked at" some time. The LA added: "The result of that look was that three vehicles had prohibition notices imposed on them".

The LA commented that under crossexamination Mr. Wishart had agreed that the vehicles were not maintained as well as they should have been.

For the applicant, Mr. J. B. T. Loudon said there was a substantial body of written evidence. On the prohibitions, he pointed out that there was no wilfulness involved. Over the three years there had been only two immediate GV9s; he did not think that was really a terribly bad record.

ON THE previous day in Glasgow, three companies were called before the LA under Section 178. All three received a warning and one, M. Kennedy, had a vehicle suspended for three months.

In the case of Thomas Greer and Sons, Holytown, Mr. James Law said that vehicles had been subject to damage on rough roads while carrying building materials and so on. The company's garage was being extended.
