• Harrogate haulier Albert Hymas had its 26-vehicle/28trailer, licence renewed when environmental objectors failed to attend a Leeds public inquiry.

The company had applied to North Eastern Deputy Licensing Authority Brian Horner to operate from.Killinghall Stone Quarry, Killinghall. The application had attracted a representation from J E and D who live on the access road.

For the company, Stephen Kirkbright said that the previous licence had also authorised an operating centre at The Grove, Harrogate. It was apparent at a public inquiry five years ago that there were growing environmental problems at The Grove, and the company had gradually moved all its vehicles to Killinghall.

Managing director Michael Hymas said the company was operating eight vehicles and about 14 trailers. It wanted to • renew its authorisation for 26 vehicles and 28 trailers in case trading conditions improved over the next five years. Three other firms used the quarry and his company's operations accounted for less than half of the vehicles using the site.

Maintenance was still handled at The Grove, but the company planned to move that to Killinghall. Mrs Ingle had mentioned that vehicles were going in and out of the Quarry late at night but she had been unable to identify whose vehicles they were, said Hyman.

Apologising for failing to disclose four overloading convictions and one for a VED offence in the application form, Hymas said that he had thought the question referred to criminal convinctions rather than technical vehicle offences.

Granting renewal, Homer said that he had been impressed that Hymas had taken the trouble to go and see Mrs Ingle, and that might be the explanation as to why the Ingles had not appeared at the Leeds public inquiry.
