A Wednesbury haulier that sent its transport manager and an office assistant to represent it at a Public Inquiry has been Oven a stay of exe cution after the inquiry was adjourned.

The disciplinary hearing against BJ Stevens Transport was put back by the West Midland Deputy Traffic Commissioner Roger Seymour for a director to attend, because the firm was in very great danger of having its licence revoked".

The company, which holds a five-vehicle licence, was represented by transport manager Douglas McMinn and office assistant Adrian Lewis when it appeared in front of Seymour.

McMinn said that director Jeffrey Stevens was unable to attend following an accident at work and the other directors, Margaret and Maxine Stevens, had not realised that it was necessary for them to be there.

The DTC pointed out that he had no medical certificate in relation to Jeffrey Stevens. He said that the allegations against the company were very serious. There had been four immediate prohibitions issued since March 2002, The company had been convicted of an overloading offence and of failing to produce tachograph records after it was found that over 50,000km were unrecorded, and had been fined a total of 11,950 with £170 costs.

He also had to be satisfied about finance, said Seymour. For its current licence, the company needed to show that it had 113,900 immediately available and for the proposed increase to seven vehicles, £18,700.

McMinn said that he did not have any financial evidence with him as he did not deal with those matters.

Adjourning the hearing for four weeks, the DTC said that because of the serious nature of the proceedings, it was absolutely essential that a director was present. He recommended that the company be legally represented, though that was a decision for the directors. The company must also submit financial evidence showing that it met the requirements.
