Which of the following most accurately describes the problem?

• Andrew Watson (Haulage) Ltd., appeared at Glasgow on January 7 to resume an application rejected on July 2 1968 and taken thereafter to the Tribunal which set aside the decision of the LA and advised that the case could be reheard. Purpose of that decision was to permit Andrew Watson to produce evidence not given at the original hearing. On that occasion the seller of the business, Mr. Wait of Bathgate, failed to appear as promised to support the application for an A licence of one articulated unit and one general goods trailer operating on a 25mile radius from Bathgate.

Mr. Campbell Wardlaw, appearing for Andrew Watson, said that arrangements had been made to present the evidence but the witness was not available when called for that morning. They would therefore regard the application as finally withdrawn. The Scottish LA, Mr. A. B. Birnie, said there was no alternative open to him but to refuse the application. He did so with "great regret."
