A TRUCK DRIVER'S not guilty plea failed to convince magistrates who handed him a fine and costs of £300 for twice exceeding his legal hours.

William Huke of Woodford Green, Essex. pleaded not guilty to driving more than 4.5 hours on two occasions without taking the required 45 minutes break but was found guilty by Harlow magistrates. He was lined £100 for each offence with £300 costs.

Anthony Ostrin. prosecuting for VOSA.said Huke was driving his Scania rigid when it was stopped at a roadside check.

Inspection of two tachograph charts revealed the offences. The first showed total driving of eight hours with a 30-minute break; the sec chart showed seven hours 26 minutes' dri with a 20-minute break. However, the ti was being driven for part of the rest time wl nullified the breaks.

Allegations against his employer, Woodi Green-based Muck-It, were dismissed.
