A Bedford-based haulier has escaped with a conditional discharge after magistrates heard how he drove a vehicle with a prohibition away from a Vehicle inspectorate test centre. John Vesper, owner of Vesper transport, drove the artIc out of the Leighton Buzzard centre last December, after officials said It could only be taken sway on a low-loader when a brake ilaphragm ruptured during an annual nspection (CND Dec 2001-2 Jan 2002).

Vesper claims that this would have nvoived notifying the police and electricity yard, taking days to organise. Instead he nada a temporary repair to the truck there knd then and drove it away.

The magistrates were shown a brake ilaphragm and Vosper described how he had blocked off the air pipe to the chamber so as to drive the antic away safely. Ha continues: "Ft was a complete waste of time and money to bring this to court. The VI should really look at their operating procedures." According to Vesper the magistrate was satisfied with his actions and said It seemed quite obvious to him that he had presented no danger to the general public by taking the trailer on to the road.

The VI has declined to comment except to say that it Is considering pursuing the case at a Public inquiry.
