• Cedric Johnson's loose form" of partnership with his nephew Peter brought an adjournment of a licence renewal hearing.

Johnson, trading as CA and PA Johnson, of Harrogate, had applied to renew his licence for five vehicles and four trailers.

After North Eastern Deputy Licencing Authority H Anthony Richardson said that accounts produced indicated that the owner of the business was Peter Johnson, Cedric Johnson said he had lost his LGV driving licence as a result of a heart condition.

His nephew had said he would take over so they formed what they thought was a loose partnership.

Richardson said that it seemed that Peter Johnson had been trading for more than 12 months under a licence granted to Cedric Johnson. If it was to be a partnership the application was invalid. What was needed was a new application in either Peter Johnson's name or in the name of them both. It was not possible to swap an operator's licence.
