BECAUSE a tachograph chart did not identify the date on which it had been used, it was dismissed as evidence at the Penrith magistrates' court this week. Mr H. Eggleston, 47. of Graham Street, Penrith, was charged with exceeding 40 mph in a commercial vehicle on A6. He produced a tachograph chart which, he claimed, showed that he had been travelling not faster than 38 mph at the time of the police check. The police submitted that there was nothing on thc chart to show that it related to the day of the check, and they stated that the defendant had been driving at between 58 and 60 mph.

The magistrates found Mr Eggleston guilty and fined him £12.
