Which of the following most accurately describes the problem?

• Bradford Waste Traders and driver Roy Flynn have been ordered to pay £1,800 in fines and costs by Heywood magistrates for drivers hours offences.

Flynn pleaded guilty to six offences of exceeding 41hours driving without the required break. He was fined between £10 and £75 for each offence and ordered to pay £25 prosecution costs. The company admitted six offences of permitting Flynn to exceed 41 hours without taking the required break.

Elizabeth Riding, prosecuting, said the offences came to light when a police officer stopped a Bradford Waste Trader's vehicle driven by Flynn. His tachograph charts showed apparent offences. Charts were later seized from the company's premises and a further 22 offences were revealed.

Helen Cousins, for the company, said that tachograph charts were inspected on a three-monthly basis.

The procedure had now been improved, with charts being inspected every two to three weeks. Drivers were paid a set weekly wage, so there was no financial gain from taking insufficient rest.

The company was fined £750 and ordered to pay £25 prosecution costs.
